§ 5.24.070. Exceptions.

  • (a)

    This chapter shall not apply to the following activities and businesses:

    (1)

    The sale of newspapers, books, periodicals, and other printed materials;

    (2)

    Outdoor sales conducted by a business, provided that the business is located within a building, and further provided that the sales are conducted at a location immediately contiguous to the business location;

    (3)

    Automobile, boat, trailer, camper, and motorcycle sales and rentals;

    (4)

    Retail lumber yards;

    (5)

    Gasoline pumps, oil racks, and accessory items when located on pump islands;

    (6)

    Christmas tree sales;

    (7)

    Fireworks sales;

    (8)

    Yard sales (a maximum of two per calendar year, not to exceed two consecutive days). All yard sales are to be operated only during daylight hours;

    (9)

    Temporary circus and carnival activities (four days maximum per event);

    (10)

    Mobile health and veterinary clinics;

    (11)

    Fund-raising activities conducted by organizations exempted from the business operations tax;

    (12)

    Sale of food from motorized vehicles which do not remain at one location in excess of 15 minutes.

    (b)

    The provisions of this section shall not relieve persons engaged in the activities listed in subsection (a) of this section from obtaining any other permit or license or complying with any other law, ordinance, rule or regulation which may be applicable to such activity.
