§ 1.16.010. General penalty designated.

  • Whenever in this code or in any ordinance or resolution of the city, any act is prohibited or is made or declared to be unlawful or an offense, or the doing of any act is required, or the failure to do any act is declared to be unlawful, the violation shall be punished as follows:

    (1)

    Those acts or omissions designated as misdemeanors shall be punished by a fine not exceeding $1,000.00 or imprisonment for a term not exceeding six months, or by both such fine and imprisonment;

    (2)

    Any act or omission which is determined to be an infraction shall be punishable by (1) a fine not exceeding $100.00 for a first violation; (2) a fine not exceeding $200.00 for a second violation of the same ordinance within one year; or (3) a fine not exceeding $500.00 for each additional violation of the same ordinance within one year;

    (3)

    Any act or omission which is not designated as a misdemeanor or infraction shall be punished as a misdemeanor pursuant to the provisions of subsection (1) of this section.
