§ 17.20.070. Improvements construction.

  • (a)

    Requirements for the construction of improvements shall be noticed by certificate on the parcel map, in the resolution waiving the parcel map, or by separate instrument and shall be recorded on, concurrently with or prior to the parcel map or resolution approving the parcel map being filed for record.

    (b)

    (1)

    Construction of such improvements shall not be required until such time as a permit or approval for development of the parcel is granted, or until such time as is required pursuant to an agreement between the city and sub-divider, unless, in the absence of such an agreement, the council determines that construction of such improvements is necessary for reasons of:

    a.

    The public health and safety; or

    b.

    The required construction is a necessary prerequisite to orderly development of the surrounding area.

    (2)

    Upon making such findings as are contemplated in subdivision (1) of this subsection, the council may fix a reasonable time within which such improvements shall be constructed.
