§ 17.16.160. Hearing before commission—Conduct—Approval or disapproval.
(a)
At the public hearing the commission shall consider the report of the subdivision committee, and hear the testimony of the subdivider and any other interested person desiring to testify relative to the tentative map. Upon closing the public hearing the commission shall recommend to the council approval, conditional approval or disapproval of the tentative map.
(b)
The commission shall base its action on the conformity of the tentative map to the requirements of the Subdivision Map Act, this title, the zoning ordinance, the general plan, and any specific plans of the city. The commission shall report its action in writing to the council. The city clerk shall serve a copy of the report on the subdivider by mail or personal delivery at least five days prior to consideration of the tentative map by the council.
(c)
If disapproval of the map is recommended, the report of the commission shall contain a statement of the reasons for such disapproval. If conditional approval of the map is recommended, the report shall state conditions of approval.
